Rent Review Reform – update

On 28 February 2005 the final report by the University of Reading on the impact of the 2002 Code of Practice for Commercial Leases was published on the ODPM website. The report considered the impact of the Code since its introduction in April 2002 against the market and institutional background. The ODPM has undertaken to consider, in the light of the report, whether it is sufficient to continue relying on voluntary measures to promote greater flexibility in the property market or instead to introduce legislation. The ODPM is now considering Reading’s final report alongside responses to its 2004 consultation paper (Commercial Property Leases: options for deterring or outlawing the use of upwards only rent review clauses).
